Scope of application
These Terms and Conditions apply to the goods sold by Mandarin Home from its online store www.shoesmall.gr.
Sales training
Once the "Order with payment obligation" button is pressed, the customer submits a proposal for the purchase of the goods in his cart and is required to agree and accept the application of these General Terms and Conditions of Purchase.
In the case of telephone orders, the customer must confirm the offered order and accept the Terms of Purchase. If it has an email address, will receive an email in which he must actively select accept by pressing the corresponding button, different, if not accepted within 5 days or refuse, his order will be canceled. If it does not have an email address, the consumer will accept the order and the Purchase Terms before the delivery of the products, otherwise the products will not be delivered.
Confirmation of receipt of the purchase proposal, which is sent automatically immediately after the order is placed, certifies that the customer's order has been received by Mandarin Home. However, does not constitute acceptance of the offer to purchase the customer.
Acceptance of the offer for purchase will take place only after the declaration of acceptance of the proposal, by Mandarin Home, which will be sent with a separate order confirmation email with shipping confirmation the confirmation of readiness to receive from the store.
Availability of goods
If the products ordered are not available or are not available at the listed price due to incorrect price indication at the time of ordering and processing, Mandarin Home reserves the right not to accept this order and, therefore the sale is not made. The customer will be informed accordingly. Any initiated or executed payments will be canceled. Any payments will be returned to the customer without undue delay, in the same way that the customer chose to make the payment, unless otherwise agreed.
Although all the necessary technical and necessary measures are taken, Mandarin Home expressly reserves the right to enter a price incorrectly due to a human or technical factor, which (price) could not correspond to the usual or average selling price of the respective product from Mandarin Home. In such a case, the customer will be informed accordingly. Any initiated or executed payments will be canceled. Regarding the products that appear with the indication available "upon order", the customer will be informed within 2 working days as to whether and when the products will be available and consequently, it will be possible to deliver them.
Delivery of product with Pickup from store or with Delivery to the place of choice - Delivery and return costs
Orders received by Mandarin Home are processed from Monday to Friday, from the 08:00 a.m. until 17:00. The processing of orders, submitted Sundays and holidays takes place the next working day.
Delivery time may also be affected by the payment method chosen by the customer (e.g. the time of completion and appearance of the bank transfer may vary depending on the Bank (usually 2-3 working days)).

Important Notes on deliveries:
- The Same Day Delivery can take place only in the urban areas of Attica. Valid only for orders placed from Monday to Friday until 15:00 and, if the relevant order confirmation is sent with the product confirmation of shipment. It concerns orders, paid by credit / debit card or PayPal. A necessary condition for the fulfillment of the specifications of the service is the existence of an elevator (1floor and up).
- Deliveries include unpacking the new device and collecting the package. Telephone communication precedes the finalization of the delivery.
- small.g, which entails an additional charge on a case by case basis. In these cases the delivery time may be extended depending on the availability of the cooperating carriers. Otherwise, delivery takes place at the external entrance of the place of dispatch (e.g. entrance of an apartment building).
- For shipments within Attica, if the order has been placed and confirmed by 14:00, delivery will take place the next business day. In the orders that are made and confirmed until 14:00 on Friday the delivery takes place until Monday.
- For shipments outside Attica, if the order has been placed and confirmed by 14:00, delivery will take place within 3 working days.
- In remote areas of mainland Greece, islands etc.. delivery can reach the 5 working days.
In case the product is selected by the customer for collection in a physical store Mandarin Home after the customer's choice, the customer will be informed electronically about when the order is ready to be received at the store (acknowledgment of receipt). The customer is obliged to receive his order within 5 days from the receipt of the relevant receipt notice. To receive the order, the customer will display the order confirmation and the receipt notice, as well as an official identity document (such as a police ID card, passport or driver's license). If the customer can not pick up his order himself, but wishes to authorize a third party, then it must send an email to Mandarin Home stating the details of the person who will receive and supply the third person - who will also carry an official identity document- in addition with a special authorization to receive the specific order legally certified by KEP or police or other Authority. If the customer has chosen to pay for his order by credit card, will also display his credit card through which he makes the purchase. It is pointed out, that, as well as after receipt of the products, the risk goes to the customer, must check upon receipt of the products he receives, as with his signature upon receipt confirms, that he received the products of his order correctly. If the customer does not receive the product within 5 days from the receipt of the notice for receipt, Mandarin Home reserves the right to withdraw from the sale. In such a case, the customer will receive a credit note of equal value to the sale price, which will be reimbursed by Media Markt in the same way that the customer chose to pay the price.
In case the product is sent to the place chosen by the customer, the product is delivered to an external partner for transport and delivery to the customer and the customer is informed electronically, that the product is ready to ship. Shipping costs are calculated based on the customer's order. Any incorrect registration by the customer and, consequence of this, incorrect calculation of shipping costs is not the responsibility of Mandarin Home, but the customer. It is pointed out that the customer can choose the transfer at his own expense and expense, however then the products are transported at their own risk. The shipping partner will contact the customer by phone within the same or the next business day from the electronic notice of shipment, in order to arrange the exact delivery time. To receive the order, the customer will demonstrate to the external carrier partner the confirmation of the order and notice of the shipment, as well as an official identity document (such as a police ID card, passport or driver's license). Under no circumstances is delivery or receipt allowed to or from a minor, nor upon authorization. Mandarin Home expressly reserves all rights, including the right to declare the sale invalid or to withdraw from it.
In case the customer wants delivery to the areas: Missing, Virus, Astypalea, Hydra, Fish hook, Σίκινος, Νήσυρος, Amorgos and Areopolis, the method of payment "cash on delivery" is not accepted. In this case, the money must be deposited through a bank.

Payment
All prices at www.shoesmall.gr are in euros and include VAT by law.
Upon completion of the ordering process, the customer can choose the payment method displayed, ie by cash on delivery, with credit card, by electronic deposit in a bank account, via PayPal, on site at the Store.
If the receipt from the Store is selected, it is not possible to pay by deposit in a bank account.
Exceptions / restrictions on the payment method related to delivery are also mentioned in the section above 5 in "Important Notes on Deliveries".
Transactions over € 500.00 may not be made in cash, therefore cash on delivery is not possible in this case. In case of payment by cash on delivery of an amount over € 500.00, Mandarin Home does not guarantee the inside 2 working days (based on POL. 1216/01.10.2014) cash deposit over 500,00 € on behalf of the customer. If you proceed with the transaction, in the event that the expense is deemed non-deductible for this reason, you expressly acknowledge that Mandarin Home is not responsible. COD is also not possible in case of receipt of the product from a store.
The data that the customer enters when making an electronic payment, are not controlled, processed or stored by Mandarin Home, but from the respective provider and / or payment server. MasterCard credit cards are accepted, Visa, Diners and American Express.
If payment by electronic bank deposit is selected through one of the associates with Mandarin Home Banking Institution, in which the latter maintains a bank account, the order is completed with the shipment along with the appearance of the bank transfer that the customer has made to the respective bank account of Mandarin Home. The time of completion and appearance of the bank transfer may vary depending on the Bank (usually 2-3 working days). If the deposit is not made within 3 working days, the order is canceled automatically. Excluded are orders placed on promotional products, so the deposit should be made within one (1) of the day. Any charges when making bank transfers, concern the banking institutions and not the Mandarin Home.
In case a refund is required, this will be done by Mandarin Home in the same way that the customer paid the price, unless otherwise agreed with the customer, without fault or unjustified delay.
Maintaining ownership
Any delivered products remain the property of Mandarin Home until final, full and complete payment of the price to her.
Right of withdrawal / Product return
If the customer is a natural person (consumer) who prepares the sale for personal use and not for the service of his individual activity (commercial, business, craft or liberally professional), then entitled to withdraw from the sale within 14 calendar days, which start from the time of delivery of the product (to the customer or carrier indicated by the latter), returning the product to its original state, charged with the cost of return and any reduction in the value of the goods.
Instructions on the exercise of the right of withdrawal
Right to withdraw from distance contracts under n. 2251/1994 (as amended by JMC Z1-891 / 2013)
You have the right to withdraw unreasonably from the distance sale exclusively within the deadline 14 calendar days, returning the product to its original state. This right starts from the day of receipt of these instructions in writing, however not before the delivery of the products. The inside 14 calendar days sending the clear withdrawal statement or sending the products, will be considered sufficient for the timely exercise of the right of withdrawal. You should know, that if you exercise your right of withdrawal in any of the ways described above, you will receive confirmation of receipt of the exercised right of withdrawal.
The products are returned at the expense of the customer with a cooperating carrier of Mandarin Home or sent by a carrier of his choice to the address: Heroes Polytechnic 27 Piraeus. The customer can also return the product in person and in front of any physical Mandarin Home store.
Consequences of withdrawal
In case of valid exercise of the right of withdrawal, any impairment of the value of the goods should be remedied with monetary compensation, as well as any fruits resulting from this impairment, only in the case and to the extent that it is due to the management of the product in a way that goes beyond the usual examination of the products in a way other than that which is necessary to establish the nature, of the features and function of the product. As usual examination and management of the product in order to determine the nature, of the features and function of the product, means the examination of the goods concerned, as it may have taken place in the manner usual in a physical store.
Product returned with a carrier of the customer's choice and not with an external shipping partner of Mandarin Home, returned at the risk of the customer. The customer bears the return costs and any impairment of the value of the product, for the determination of which Mandarin Home expressly reserves the right to receive the returned goods. If the product is received and checked for any impairment of its value, will be returned to the customer any financial obligation to him (e.g. paid delivery costs, price) the manner in which this payment was made by the customer, unless otherwise agreed with him. The refund obligation will be fulfilled without undue delay and within 14 calendar days from the return of the product.
The right to withdraw from the provisions of n. 2251/1994 does not apply:
- In cases where the price of the products has been paid in a physical Mandarin Home store and at the same time, these have been received from the physical store, as the sale is not considered to have taken place remotely.
- In cases where the products have been used. Use of a product recommends e.g.: the installation, the commissioning, The customer can also return the product in person and in front of any physical Mandarin Home store.
- In cases where the delivered products have been manufactured according to the specifications set by the customer or according to his personal requirements and personalizations or which by their nature are impossible to return by shipment.
Products that are personalized with the registration of the device (registration) by the customer after their delivery to him fall under this exception.
- In cases where the delivered products are carriers of audio or video or image and audio or software and have been unsealed from their packaging.
- In cases where the delivered products are not suitable for return as soon as they are unsealed for health reasons or for hygiene reasons (e.g. shavers / epilators, electric toothbrushes, cooking utensils etc.).
- In cases of supply of digital content not provided on a physical medium, if the execution started with the previous explicit consent of the consumer and the confirmation by him that he loses the right of withdrawal.
- In cases of service provision, after full service, as the consumer has already recognized at the time of ordering, that he loses the right of withdrawal if the contract is fully performed.
- In cases of food supply, beverages or other goods, intended for current consumption within the household and generally in the case of consumables once they have been opened (e.g. unopened printer consumables).
Reduction of product value
The consumer should manage each product, who receives in the way that he would manage and examine this and in a physical store, to ascertain nature, its features and function. Product management, which is different from the description above, will not be accepted. Therefore, the consumer may be burdened with a reduction in the value of a product, if the management he has done in it exceeds the acceptable measure. Although any decrease in value is judged on a case by case basis, The relevant table of value reduction cases per product category is given below, where the maximum possible percentage reduction of the price is indicated, as it is not possible to calculate these charges in advance accurately. It is pointed out that in any case, any accumulation of value reduction criteria may result in a value reduction of up to 85%.
Table of indicative value reduction per case:
- Products, which are returned with worn packaging, will be subject to a reduction in the return value 10%.
- Products, which are returned without packaging or accompanying documents, will be subject to a reduction in the return value 15%.
- Products, which are returned without accessories,any gifts, accompanying products and materials, will be subject to a reduction in the return value 30%.
- Products that are returned and have been installed / put into operation, will be subject to a reduction in the return value, as follows:
- Televisions, HiFi, Car HiFi, Photographically, GPS, accessory, displays 30%.
- Tablets, printers, multifunction machines, consoles, IT accessories & Gaming accessories 40%.
- Large and small household appliances, Laptop, Desktop-AiO, Smartphones, cell phones, steadily & wireless phones 50%.
- Cookware 60%.
- Products that have used their accessories (such as 3D glasses, headphones, support bases etc.), will be subject to a reduction in the return value 15%.
The above percentages of reduction of the value of the products lie, Especially, in cleaning and repair costs and, if the goods can no longer be sold as new, objectively justified loss of income in the event of the sale of the returned good as second-hand. In case the product is used by the consumer in a way that can not even be resold as a used, the reduction in value will amount to at least a percentage 85%.
In case of valid exercise of the right of withdrawal and provided that the product has been returned to Mandarin Home, the customer will receive a credit note of equal value to the sale price, which will be reimbursed by Mandarin Home in the same way that the customer paid the price, unless otherwise agreed with the customer, without fault or unjustified delay. Mandarin Home will refund any payment received within 14 calendar days from the day on which it was informed of the decision to withdraw from the contract. Mandarin Home reserves the right to refuse a refund until the product is returned to it or until the consumer provides proof that he has sent the product, whichever comes first. It is explicitly agreed and the client already provides his irrevocable order and consent to this, Mandarin Home is entitled to deduct the return costs from the refunded amount, which are the responsibility of the customer (as in the table above in section 5) as well as any compensation in case of disaster, wear or damage of the product or impairment of the value of the product due to customer actions. Mandarin Home in any case has the right to claim in any legal way any amount that was damaged (indicative, either in terms of reimbursement costs or disaster, wear or damage, impairment of the value of the product, etc.). It is explicitly agreed, already at the pre-contractual stage before the order is submitted, that the Company is entitled to withhold part of the price and to offset any loss resulting from a reduction in the value of the product under no.. 5 section above with the refund amount in case of withdrawal. This term is one of the unconditional conditions for the conclusion of the contract and its legal basis.
Consumer rights - Liability - Force Majeure
Consumer rights deriving from the provisions on the sale of consumer goods and guarantees of the Civil Code (such as the right of correction or replacement - unless such action is impossible or requires disproportionate costs- the right to reduce the price, the right to withdraw from the contract - unless it is an insignificant defect- due to a real defect or lack of agreed capacity, for duration two (2) years from the date of delivery), of art. 5 of n. 2251/1994 (such as the consumer's right to request a temporary replacement of the product, in case the required repair time for the product under warranty exceeds 15 working days), as well as any other consumer protection provisions, apply as they are.
Claims for compensation or monetary satisfaction of any nature and legal basis, are excluded. The same, claims for damage to health are excluded, of life and bodily integrity.
Any claim for compensation or monetary satisfaction of any nature and legal basis is excluded, in case of force majeure assistance.
Claims for defects - Service
The customer is also entitled, within the legal timeframes and, regardless of the right of unjustified withdrawal within 14 days from the provisions of law 2251/1994, to exercise its statutory rights due to product defects before any Mandarin Home store in Greece.
If a product is declared defective by the customer, Mandarin Home expressly reserves the right to pre-diagnose the product as defective by competent technicians.
If a product is returned as defective and receives a specific repair order number, the customer can receive all the necessary information regarding the processing and processing of any order related to any defect, based on the repair order number.
The assignment or transfer of rights regarding the defectiveness of the products is excluded.
In case a customer does not receive the product from the Service within 3 months from the date of delivery of the product (in Service), accepts and declares irrevocably and unreservedly, that he leaves the prefecture of the product for the purpose of renouncing ownership and renounces all rights / performance claim, claim, compensation, etc..
On non-warranty devices and if the product has not yet been repaired, a minimum inspection fee may be charged.
Mandarin Home is not responsible for the loss, damage, file destruction, other data and data stored by users on the products. It is recommended that the user back up and save the files, data and other information provided by them.
Final provisions
These general terms and conditions are governed by Greek law. Any dispute that arises and which arises from the contractual relationship between Mandarin Home and the customer, competent for its resolution are the substantively competent Courts of Athens. For out-of-court settlement of the dispute you can contact the competent bodies for out-of-court settlement of consumer disputes, e.g. at the General Secretariat for Consumer Affairs of the Ministry of Development and Competitiveness (Sq. The protection reserved by the provisions of the law on contracts concluded remotely, as well as these terms, underlined, that applies to transactions only with natural persons, which are traded for reasons, which do not fall under the commercial, craft, business or their free professional activity.
In case of non-application of any term of this agreement, the others remain in full force and effect.
